Terms of Service
These terms are an agreement between you and Ember Technologies, LLC for your use of Relic. We have kept them as short and readable as we can.
Who we are
Relic is provided by Ember Technologies, LLC, a Montana limited liability company located at 3507 Tommy Armour Circle, Billings, Montana 59106, USA. In these terms, "we", "us", and "Relic" refer to Ember Technologies, LLC, and "you" refers to the person or organization using Relic.
By creating an account or using Relic, you agree to these terms. If you do not agree, please do not use Relic.
Eligibility
You must be at least 16 years old to use Relic. By using it, you confirm that you are at least 16 and able to enter into a binding agreement.
Your account and your key
You are responsible for keeping your account credentials and your one-time recovery key safe, and for activity under your account.
Because only you can unlock Relic, we cannot access your content or reset your encryption. If you lose your recovery key, your data may become permanently unrecoverable. Please store it somewhere secure, and tell us at support@relic.space if you believe your account has been used without your permission.
Your content is yours
You keep all rights to what you capture in Relic. Because your content is end-to-end encrypted with a key only you hold, we cannot access it, and we make no claim to it.
You grant us only the limited rights we need to operate the service: to store, transmit, and sync the encrypted form of your content across your devices. We do not use your content to advertise to you or to train AI models.
Acceptable use
Use Relic for your own lawful purposes. Do not use it to break the law, to infringe others' rights, or to store or share content you are not permitted to. Do not attempt to disrupt or attack the service, gain unauthorized access to it, or interfere with other users.
Because we cannot see your content, you are solely responsible for what you choose to store in Relic.
Plans, billing, and refunds
Relic offers a free tier and a paid Pro subscription. Pro is billed through Stripe on a recurring basis (monthly or annual) until you cancel, and by subscribing you authorize those recurring charges.
You can cancel at any time; your access continues through the end of the current billing period, and we do not pro-rate partial periods unless the law requires it. If you are not satisfied, you may request a full refund within 30 days of a direct purchase by emailing support@relic.space. Yearly plans renew at the then-current yearly price, and we send a reminder email before each yearly renewal. Purchases made through an app store are governed by that store's refund policy.
We may change our prices with notice; changes apply to your next billing period. You are responsible for any applicable taxes.
Changes to the service
Relic is under active development and may be offered in beta. We may add, change, or remove features as the product grows. We try to avoid disruptive changes, but we cannot guarantee that any particular feature will always be available.
Provided as is
Relic is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We work hard to keep your data safe and the service reliable, but we do not warrant that it will be uninterrupted, error-free, or secure, or that data will never be lost. Keeping your recovery key safe is your responsibility.
Limitation of liability
To the maximum extent permitted by law, Ember Technologies, LLC and its owners and members will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any lost profits or lost data, arising out of or relating to your use of Relic.
Our total liability for any claim relating to Relic is limited to the greater of the amount you paid us in the 12 months before the claim or US$100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Ember Technologies, LLC from any claims, damages, or expenses arising out of your misuse of Relic or your violation of these terms or of applicable law.
Termination
You may stop using Relic and delete your account at any time. We may suspend or end your access if you breach these terms or to protect the service or other users. When your access ends, your right to use Relic stops, and we handle deletion of your data as described in our Privacy Policy.
Governing law and disputes
These terms are governed by the laws of the State of Montana, USA, without regard to its conflict-of-law rules. Any dispute arising out of or relating to Relic or these terms will be resolved exclusively in the state or federal courts located in Yellowstone County, Montana, and you consent to the personal jurisdiction of those courts.
Changes to these terms
We may update these terms as the product grows. If we make a meaningful change, we will update the date below and, where appropriate, let you know. Your continued use of Relic after a change means you accept the updated terms.
